Heard learned counsel for the applicants and learned A.G. A. for the State.
Learned counsel for the applicants submits that it is matrimonial dispute and prays that the matter may be referred to the Mediation Centre.
It is directed that applicants shall deposit a sum of Rs. 6000/- within a period of three weeks from today with Mediation and Conciliation Centre. Out of the amount so deposited, opposite party No.2 shall be given Rs. 3000/- for her to and fro journey and Rs.3000/- be deposited with the Mediation Centre.
Let this order be placed before the Registrar/ in charge of 'Allahabad High Court Mediation and Consolidation Centre'. The Registrar/ in charge of the Mediation Centre, shall fix a date and every efforts shall be made for re-conciliation and complete the process of mediation within three months from today. In the event, the effort is not successful, the case will be listed after three months, along with report of conciliator.
Till the next date of listing, non-bailable warrant issued against the applicants shall be kept in abeyance and further proceedings of case No.17750 of 2009 State V. Hafiz Mohd. Anwar and others in case rime No.350 of 2004 under Section 498A, 323, 504 I.P.C. P.S. Kidwai Nagar, shall remain stayed provided the applicants appears on each and every day before the Mediation Centre without fail and also pays Rs. 2000/- on each date to opposite party No.2 for her to and fro journey. In the even of default, this interim order shall stand automatically vacated and the opposite party will be at liberty to make recovery of arrears of maintenance.
