Heard learned counsel for the applicant and learned A.G.A.
It is alleged by learned counsel for applicant that the prosecution is false; applicant is brother of the deceased; applicant is languishing in jail since 4.3.2018 and he is entitled to be released on bail.
Learned A.G.A. have vehemently opposed the prayer for bail and submits that as per prosecution case applicant shot dead his sister; the assault weapon was recovered on his pointing out; post-mortem report of the deceased corroborates the cause of death by fire arm injury; the applicant is not entitled to be released on bail.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant, Hafeez, involved in Case Crime No. 117 of 2018, under Sections 302 I.P.C., Police Station Kampil, District Farrukhabad.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of one year from the date of production of a certified copy of this order, if, there is no legal impediment.
The Registrar General of this Court is directed to send a copy of this order to the learned trial court for compliance.
