1. This Court (Coram : Mr.Justice Anant S. Dave) vide order dated 07.12.2011 had passed the following order :
"Learned AGP seeks time.
However, it is expected of the authority to take decision with regard to transfer of the petitioner out of the District in light of oral judgment dated 14.7.2011 in Letters Patent Appeal No. 1030 of 2011 where their Lordships have relied on the decision rendered in Letters Patent Appeal No. 2277 of 2010 decided on 17.2.2011.
Stand over to 27.12.2011."
2. It transpires from the record that on 7.12.2011, in fact learned Assistant Government Pleader appearing for the respondent State sought time to take instructions in the matter. However, no reply is filed.
3. Considering the above facts, respondents are directed to file an affidavit explaining as to why direction issued in the order dated 7.12.2011 is not complied with till date by filing affidavit on or before 27.2.2012. If no affidavit is filed, respondent no.2 is directed to remain present personally on 27.2.2012. S.O. to 27.2.2012. Direct service permitted.
