(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) This is an application at the instance of the claimants-respondents for withdrawal of further amount out of the amount deposited by the Insurance Company.
After taking into consideration the fact that the claimants have already been permitted to withdraw a sum of Rs.4,93,010=00 and further permitted to enjoy interest arising out of the fixed deposit of Rs.18 lac and odd, we do not find any reason to pass any further direction for withdrawal of lump-sum amount.
Since the Appeal is pending from the year 2004 and is otherwise ready, we fix the Appeal for hearing after three weeks.
The Application is, thus, disposed of with the above directions.
