A prosecution under Section 379 IPC is sought to be quashed under Section 482 Cr.P.C. The offence is compoundable under Section 320 (1) Cr.P.C. It is not known why the parties have come before this court for relief. When normal relief under the code of Criminal Procedure is possible, and that can be sought in the court below, this court cannot exercise jurisdiction under Section 482 Cr.P.C. The petitioners will have to approach the trial court, report composition, and have it recorded in the proceedings. In the result, this Crl.M.C is closed with observation that the parties will have to approach the trial court for composition under Section 320(1) Cr.P.C.
