JUDGMENT / ORDER

HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY C.R.P.No.1441 of 2014 Date : 9-7-2014 Between :
Habeeb Mahammed Alkaf and others ..
Petitioners And Ali Bin Ghouse Al Jabri and others .. Respondents Counsel for petitioners : Sri D.L. Pandu for Sri S. Girimoji Rao Counsel for respondents : --
The Court made the following :
ORDER:
This Civil Revision Petition is filed under Article 227 of the Constitution of India feeling aggrieved by the non-grant of ad interim order by the lower Court.
A perusal of the record shows that by order dated 29- 4-2014, the lower Court has ordered urgent notice returnable on 2-6-2014.
In my opinion, this revision petition is wholly misconceived as ordinarily it falls wholly in the realm of the discretion of the civil court whether to grant ad interim order or order urgent notice. This Court, while exercising its supervisory jurisdiction would not normally interfere with the discretion exercised by the lower Court if on the facts and circumstances of the case it has not shown inclination to grant an ad interim order and instead chooses to order urgent notice. Therefore, I do not find any reason to interfere with the discretion exercised by the lower Court in ordering notice to the respondents.
The Civil Revision Petition is accordingly dismissed.
As a sequel to the dismissal of the Civil Revision Petition, CRPMP No.2012 and 2654 of 2014 filed for interim relief are disposed of as infructuous.
