Heard learned counsel for the petitioners; learned AGA for respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 25th September, 2019 registered as Case Crime No.399 of 2019, under Section 3(1) of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986 at Police Station Cholapur, District Varanasi.
The allegation made in the impugned first information report discloses commission of cognizable offences. The record further reveals that there are five cases against the petitioners 1 and 2 and six cases against the petitioner no.3.
Under the circumstances, the prayer of the petitioners to quash the first information report cannot be accepted.
In view of the above, the petition is dismissed without prejudice to the right of the petitioners to apply for bail as may be advised.
