JUDGMENT / ORDER

1. Learned counsel for the appellant is permitted to place on record the affidavit.
2. It is submitted by learned Senior Counsel, Mr. K.M.Patel for Mr. Udayan Vyas for the appellant that if applicant files representation before the respondent-Corporation, then Corporation may be directed to decide the same on its own merits, in accordance with law without prejudicing to the rights of the appellant and without being influenced by the order passed by this Court today.
3. Both the learned counsel for the respective parties made a join statement at the bar that if suit is directed to be decided expeditiously, they would not invite for reasoned order.
4. In view of the above joint statement, without going into the merits of the matter, City Civil Court, Ahmedabad, is directed to dispose of pending Civil Suit, as expeditiously as possible preferably within two years from the date of receipt of a copy of this order on its own merits, in accordance with law and without being influenced by the order passed below injunction application as well as this order.
5. In the event of the appellant making a representation before the respondent - Corporation, the respondent-Corporation may decide it on its own merits, in accordance with law and without being influenced by this order.
6. With the above directions and observations, this First Appeal and Civil Application stand disposed of. Notice is discharged.
