For Petitioner : Mr.Hariharan for Mr.V.Nicholas ORDER The plaintiffs in O.S.No. 30 of 2014 on the file of Additional District Court, Hosur, has filed the above Civil Revision Petition to direct the Trial Court to dispose of the application in I.A.No. 204 of 2015 in O.S.No. 30 of 2014, within a time frame.
2. The plaintiffs filed the suit in O.S.No. 30 of 2014 for specific performance. The defendants filed their written statement and are contesting the suit. Subsequently, the first respondent filed an application in I.A.No. 2014 of 2015 to implead him in the suit.
3. The learned counsel appearing for the petitioners submitted that the plaintiffs filed their counter and are contesting the application. Further, the learned counsel submitted that the Trial Court has not disposed of the same in spite of the fact that the application is pending for nearly two years. The learned counsel also submitted that in view of the long pendency of the matter, the plaintiffs are put to hardship and prejudice.
4. Having regard to the submissions made by the learned counsel appearing for the petitioners and also taking into consideration the limited prayer sought for in the Civil Revision Petition, without expressing any opinion with regard to the merits of the case, I direct the Additional District Court, Hosur to dispose of the application in I.A.No. 204 of 2015 in O.S.No. 30 of 2014, on merits and in accordance with law, within a period of four weeks, from the date of receipt of a copy of this order.
With this observation, the Civil Revision Petition is disposed of.
No costs.
