3. Assistant Revenue Officer, Marathhalli Sub-Zone, No.518, Varthur Road, Marathahalli Village, Marathahalli, Bengaluru-560 037. ... Respondents (By Sri N. R. Jagadeeswara, Advocate) These Writ Petitions are filed under Articles 226 and 227 of the Constitution of India, praying to quash the endorsement issued by the respondents dated 04.01.2018 produced at Annexure-A, quash the circular issued by the respondents dated 20.10.2014 produced at Annexure-B and direct the respondents transfer the Khata of the petition schedule property, in the name of the petitioners, in accordance with the Final Decree drawn up by the Hon’ble trial Court in O.S.No.575/2007 produced at Annexure-E.
These Writ Petitions coming on for Preliminary Hearing ‘B’ Group this day, the Court made the following:
ORDER Learned counsel for the petitioners has filed a memo dated 25.04.2019, seeking liberty to withdraw the writ petitions.
2. However, it is stated that liberty to challenge the validity of imposition of betterment levy by respondent - Bruhat Bengaluru Mahanagara Palike may be reserved.
3. Taking note of the said submission and the memo filed, petitioners are permitted to withdraw the writ petitions reserving liberty to challenge the validity of raising the demand as regards betterment levy.
Accordingly, writ petitions are disposed of.
