1. Learned advocate for the parties have jointly requested the Court to dispose of this matter in terms of the compromise arrived at between the parties. The workman is present in the Court, who has been identified by the advocate Shri Asit B Joshi. The workman has also unequivocally stated before the Court that, he has understood the compromise and has satisfied qua receiving Rs.80,000/- and he know that, thereafter, nothing remains to be recovered from the employer.
2. In light of this, this petition is disposed of and the award is modified. As per the modified award the workman is said to be entitled to receive Rs.80,000/- towards all his claims arising from the reference in question. As learned advocate for the workman submits that the cheque is handed over, now the petition be disposed of. In light of this development, the petition is disposed of. The award shall stand modified. Rule is made absolute to the aforesaid extent. However, there shall be no order as to costs.
3. In view of the order passed in the main petition, civil application no. 1574 of 2011 will stand disposed of with the main matter.
