In this petition under Section 482 of the Code of Criminal Procedure a prayer has been made that the court concerned may be directed to consider the bail application of the applicant in Case Crime No. 341 of 2010, under Section 2/3 of U.P. Gangesters & Anti Social Activities (Prevention) Act, 1986, Police Station Sector 39, Noida, District Gautam Buddha Nagar pending in the court concerned and the same may be disposed of same day.
The petition is finally disposed of with a direction to the lower court that if the applicant surrenders in the court within three weeks from today his ail application shall be disposed of in the light of the judgment passed by 7 judges Bench of this court in Amarawati and another Vs. State of U.P., 2005 Cr.L.J. 755 as approved by the Apex Court in Lal Kamlendra Pratap Singh Vs. State of U.P. in criminal Appeal No.538 of 2009 Supreme Court dated 23.3.2009.
