Heard learned counsel for the petitioner, learned Standing Counsel for the State respondent and Sri Pranjal Mehrotra, learned counsel for the respondents no. 2 to 4.
Sri Pranjal Mehrotra, on the basis of instruction, says that the petitioner is a married daughter whereas under the Dying-in- Harness Rules, 1974, she is not included in the definition of family and therefore, her claim for compassionate appointment under the Dying-in-Harness has not been considered by the respondent.
Learned counsel for the petitioner, however, says that now an amendment has been carried out in the Dying-in-Harness Rules, 1974 and even married daughter are entitled for being given appointment on compassionate grounds.
This writ petition is disposed of with the direction to the petitioner to make a fresh representation to the respondent no. 4 annexing a copy of the amended 1974 Rules and the respondent no. 4 shall thereafter pass a reasoned and speaking order on the representation of the petitioner within a period of three months from the date of receipt of such representation and a copy of this order.
