Heard Sri Om Prakash Singh Sikarwar, learned counsel for the petitioner. No one appears for respondent no. 1 although notice has been accepted by Sri K.R. Singh. Learned Standing Counsel represents the respondent no. 2.
The petitioner in the writ petition is seeking a direction to the Vice Chairman, Gorakhpur Development Authority to stop the installation of the Cell Phone Tower on plot no. 942, Mahadev Jharkhandi, Tukada No. 1, Tehsil Sadar, Gorakhpur. The petitioner has not impleaded the Mobile Company whose tower is being installed nor has he impleaded the person who is the owner of the plot no. 942.
We, therefore, dismiss the writ petition with liberty to the petitioner to file a fresh writ petition impleading all necessary parties.
