Heard learned counsel for the petitioner and learned Standing Counsel for respondents State. Notice need not to be issued to respondent nos. 4 to 11, at this stage.
It is contended that an application was moved by petitioner on 30.07.2020 before the Sub Divisional Magistrate, Modinagar, Ghaziabad for removing the encroachment made on the land of the Gaon Sabha but till date the same has not been attended.
Sub Rule 6 of Rule 67 of the U.P. Revenue Code Rules, 2016 provides for the period in which proceedings initiated under Section 67 has to be concluded.
In view of the above, respondent no. 3 is expected to comply the provisions of Sub Rule 6 of Rule 67 of the U.P. Revenue Code Rules, 2016, in accordance with law, after hearing all the concerned parties, from the date of receipt of a copy of this order downloaded from the official website of the High Court.
