Heard Dr. Akhilesh Kumar Sharma, learned counsel for the petitioner. He has filed a supplementary affidavit today which is taken on record.
This petition has been filed for a direction to the Additional Civil Judge (Senior Division), Allahabad, Court No. 15 to decide the Original Suit No. 1139 of 2010 ( Brijeshwar Prasad Agrawal (deceased) Vs. Kamta Prasad Agrawal (deceased) and others) expeditiously.
It appears that a suit for cancellation of a will deed and for injunction was filed by the petitioners in the year 2010. It is stated that written statements on behalf of the defendants were duly filed but even after the passage of such a long time, the issues have not been framed by the court below. Learned counsel for the petitioner has referred to the certified copy of the order-sheet that has been filed today along with the supplementary affidavit.
Considering the facts and circumstances of the case, the court below is directed to take expeditious steps for framing of the issues within a period of six months from the date of filing of a certified copy of this order before it and, further to proceed with the case thereafter, expeditiously without granting unnecessary adjournment to either of the parties.
With the aforesaid observation, this petition is disposed of.
