It is stated that the sanctioned staff in the institution was determined by the State in ignorance of earlier order dated 8.11.1994. Apparently this order was not placed before the State. Petitioner wants reconsideration of the sanctioned strength after taking note of the order dated 8.11.1994. Upon a representation of the petitioners, comments have been called for by the Director of Education on 7.10.2014, which has been duly submitted but according to the petitioner, no final decision has been taken by the State in that regard.
Learned counsel for the petitioner submits that the matter could be reconsidered at the level of the State Government, in accordance with law.
Considering the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration to the claim of the petitioners for re-determination of sanctioned strength of teaching and non teaching staff, keeping in view the alleged order dated 8.11.1994, after calling for appropriate comments from the authority concerned. The required action shall be taken within a period of four months from the date of presentation of certified copy of this order.
