Heard learned counsel for the parties.
This transfer application has been filed on the ground that the opposite party's brother-in-law delivers milk to the Presiding Officer before whom the case sought to be transferred is pending. In this regard a report was called for from the said Judicial Officer.
His comments to the allegations made in the transfer application is available on record.
The allegations made in paragraph 18 of the affidavit filed in support of the transfer application has been categorically denied. The name and details of the person who delivers milk at the residence of the Presiding Officer has been stated in the comments.
It has also been stated that the person delivering milk at his residence is no way connected to the opposite party and is not related to her.
It is therefore clear that not only as the allegation in the transfer application being categorically rebutted, nothing further, to dispute the rebuttal, has been brought on record. The allegation made in the transfer application therefore, cannot be accepted.
The transfer application is accordingly found to be without merit and is dismissed.
