Heard learned counsel for the applicant, Sri Sanjay Singh, learned AGA-I, appearing for the State and perused the material brought on record.
It has been contended by the learned counsel for the applicant that the applicant has been falsely implicated in the present case due to ulterior motive. It is next submitted that the marriage of Gyan Chandra @ Sadhu -applicant herein was solemnized with the deceased and after ten months of the marriage on 18.9.2020 she has committed suicide by hanging herself. A general role has been attributed to all other family members including the applicant. As per the opinion of doctor the cause of death is asphyxia due to ante mortem hanging. Postmortem report reveals that this is typical case of suicide by hanging. There is no dying-declaration or suicide note left by the deceased. It is next contended that co-accused namely Rupa Devi, Smt. Lalmani, Lal JI Harijan, Ankit and Shivbabu have already been granted bail by another Benches of this Court vide orders dated 12.1.2021, 24.3.2021, 15.6.2021, 6.7.2021 and 3.8.2021 passed in Criminal Misc. Learned A.G.A. has vehemently opposed the prayer.
Courts have taken notice of the overcrowding of jails during the current pandemic situation (Ref.: Suo Motu Writ Petition (c) No. 1/2020, Contagion of COVID 19 Virus in prisons before the Supreme Court of India).
