Heard learned counsel for the petitioners and Shri B.B. Pandey, learned Addl. Chief Standing Counsel. Shri R.C. Upadhyay has accepted notice on behalf of Gaon Sabha.
The petitioners are before this Court directing the Sub Divisional Officer to decide the case regarding exchange under Section 101 of U.P. Revenue Code, 2006 within stipulated period and till disposal of the said case, no coercive action shall be taken against the petitioners.
The writ petition is disposed of directing the Sub Divisional Officer to decide the aforesaid case under Section 101 of U.P. Revenue Code, 2006 after hearing the State of U.P. and Gaon Sabha concerned, in accordance with law, preferably within a period of three months.
Till the disposal of the aforesaid case or for a period of three months, whichever is earlier, no coercive action shall be taken against the petitioners.
