Heard Sri Anil Srivastava, Senior Advocate, assisted by Sri Pyush Kumar Singh, learned counsel for the applicant, Sri Pradeep Kumar Tiwari, learned counsel for the informant as well as learned A.G.A. for the State.
The present anticipatory bail application has been filed by the applicant- Gyan Singh Pasi in Case Crime No. 333 of 2019, under Sections 376, 506 I.P.C., Police Station- Dhoomanganj, District- Allahabad with the prayer to grant anticipatory bail to him.
I have perused the averments made in the first information report, the order by means of which the anticipatory bail application has been rejected by the court below as well as the material placed on record.
After hearing learned counsel for the parties as well as learned A.G.A. and considering the fact that the prosecutrix who is a minor girl has been raped by the applicant on the pretext of marrying her and in respect of which she has given a detailed version in the first information report and in her statement under Section 164 Cr.P.C., the gravity of offence and the severity of punishment, no case for grant of any indulgence is made out.
Accordingly, the application for anticipatory bail is rejected.
