Heard learned counsel for the petitioner, learned A.G.A. and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that suitable direction may be issued to respondent nos. 4/3 to complete the investigation of the matter relating to FIR dated 13.05.2017 in Case Crime No. 0129 of 2017 under sections 419, 420, 4687, 468, 120B, 504, 506 IPC, PS. Salempur, District Deoria.
Learned counsel for the petitioner submits that petitioner is the informant of the case. He lodged the present F.I.R. on 13.5.2017 but till date, the investigation has not been concluded, hence, he has come up before this Court by filing the present petition. He further submits that the accused of the present case approached this Court in Crl. Misc. Writ Petition No. 11129 of 2017 in which, their arrest was stayed by another co-ordinate Bench of this Court vide order dated 14.06.2017.
Copy of the aforesaid order has been produced by learned counsel for the petitioner which is taken on record.
Learned A.G.A. could not dispute the aforesaid fact as argued by learned counsel for the petitioner.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of three months from the date of production of a certified copy of this order in accordance with law.
The S.P. Deoria shall ensure compliance of the present order within the aforesaid period.
With the aforesaid order, the present petition stands disposed of.
