High Court Of Judicature at Allahabad|26 July, 2018

JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 43183 of 2002 Petitioner :- Gyan Chand Srivastava & Others Respondent :- District Basic Education Officer, Deoria & Others Counsel for Petitioner :- Rakesh Kumar Srivastava Counsel for Respondent :- C.S.C.,S.D. Sahai
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioners have sought following reliefs:
“(a) a writ order or direction in the nature of mandamus commanding the respondent no. 1 District basic Education Officer, Deoria to accept and entertain the application forms of the petitioners and their candidature may be considered for the appointment of teachers in primary schools.
(b) a writ order or direction in the nature of mandamus directing the respondent no. 1 to call the petitioners who are holding higher B.Ed. Degree in interview and to consider the case of petitioners for such appointment as Assistant Teachers in basic Primary Institutions (run and controlled by the U.P. Board of basic Education)in case B.T.C. training holders are not available in requisite number.
(c) a writ order or direction in the nature of mandamus directing the respondents to issue appointment orders to the members of petitioners association who have been finally selected.”
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
