JUDGMENT / ORDER

This petition is filed praying to permit the petitioner to deposit a sum of Rs.20,000/- yearly towards the education expenses for Ms.A.Manisha, D/0.Late.Arumugam into the credit of Crime No.610/2016, on the file of the Hon'ble XVIII Metropolitan Magistrate, Saidapet, Chennai.
2.By consent of both sides, this Criminal Original Petition is taken up for final disposal.
3.In Criminal O.P.No.22335 of 2016, this Court has passed the following order:
..5.The petitioner is ordered to pay the following compensation on or before 10.11.2016:
(i)The petitioner shall pay a sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only) each as compensation to the three persons who sustained grievous injuries.
(ii)The petitioner shall pay a sum of Rs.1,00,000/-(Rupees One Lakh only) each as compensation to the five persons who sustained simple injuries.
(iii)The petitioner shall deposit a sum of Rs.15,00,000/- (Rupees Fifteen Lakhs only) in the fixed deposit in the name of the minor girl who lost her father in the accident, with the learned Principal Judge, City Civil Court as a guardian. The said fixed deposit shall recur till the minor girl attains majority.
(iv)Further, considering the fact that the grand father as well as the father of this petitioner is an Advocate by profession, I am confident that they will ensure that the minor girl who had lost her father in the accident and is now under the custody of her relatives will be provided good education and they will bear all the educational expenses, besides the fixed deposit of Rs.15 lakhs.
4.Insofar as Paragraph 5 (iv) of the order is concerned, the petitioner had complied with the said order by making the fixed deposit of Rs.15 lakhs. With regard to the educational expenses directed to be borne out by the petitioner, the petitioner had sent a cheque bearing No.017657 dated 01.09.2017 for sum of Rs.20,000/- on 31.08.2017 to the Headmistress of St.Joseph Matric School, Tirutani, wherein the victim's child is studying. However, the said postal cover was returned to the petitioners with an endorsement refused.
5.It is needless to point that the petitioner has chosen to send the amount pursuant to the compliance of this Court dated 25.10.2016. Hence, there was no justification on the part of the school to return the money which was meant for the educational expenses of the victim's daughter Ms.A.Manisha.
6.I am of the view that the petitioner can be permitted to deposit a sum of Rs.20,000/- every year in the name of the victim's daughter Ms.A.Manisha, to the credit of Crime No.610 of 2016, on the file of XVIII Metropolitan Magistrate, Saidapet, Chennai.
7.In the result, this Criminal Original Petition stands allowed. The petitioner is permitted to deposit a sum of Rs.20,000/- every year towards the educational expenses of Ms.A.Manisha, D/o.Late G.Arumugam, to the credit of Crime No.610 of 2016, on the file of XVIII Metropolitan Magistrate, Saidapet, M.S.RAMESH.J, rm Chennai and the learned XVIII Metropolitan Magistrate, Saidapet, Chennai, is permitted to disburse the amount so deposited by the petitioner, towards the educational expenses of Ms.A.Manisha, D/o. Late G. Arumugam.
