JUDGMENT / ORDER

The second respondent was allotted flat No.M251 at Ellis Nagar scheme on 15.06.1982. After allotment, the second respondent has sold the property in favour of the petitioner on 25.11.1995. Pursuant to the same, the petitioner has been remitting the monthly instalments to the first respondent and according to him, the entire monthly instalments have been settled. Hence, the petitioner had made a request to the first respondent asking them to execute a sale deed in his favour, which has not been considered. Hence, the petitioner is before this Court.
2.There is no representation for the respondents. No counter affidavit is filed. Nevertheless, it is for the respondents to come forward and put forth their case to clarify as to whether the petitioner is entitled for sale in his favour and that he has settled the entire sale consideration?
3.In view of the same, the petitioner is granted liberty to make a fresh representation before the first respondent seeking for execution of sale deed in his favour and on receipt of the same, the first respondent shall consider it on merits and pass orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
4.With the above direction, this writ petition is disposed of. No costs.
