JUDGMENT / ORDER

HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 25825 of 2014 Date: 19.9.2014 Between :
Guttapalli Anjalidevi W/o Prasada Rao Door No. 37-1-424 (4A) Ramnagar, ONgole … Petitioner and The Union of India, Ministry of Road, Transport and Highways, Rep by its Secretary, Transport Bhavan, Parliament street, New Delhi and others … Respondents The Court made the following:
HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 25825 of 2014 ORDER:
Petitioner claims to be the owner of land to an extent of 484 sq yards in Survey NO. 27, Pellur village, Ongole municipality, Prakasam district. Land acquisition proceedings were initiated in the year 2009 for the purpose of widening the national highway. Case of the petitioner is that even though land acquisition notification dated 30.11.2009 does not include the property of the petitioner, his property is also being utilized for leveling and other purposes and having come to know of the same, he has also issued notices to respondents but there was no response and aggrieved thereby this writ petition is instituted.
Learned standing counsel representing National Highways Authority of India submitted that petitioner’s land was not part of the notification and the same is not acquired so far and if the land of the petitioner is required, due process will be followed before acquiring the land of the petitioner. Since no other material is placed on record in support of the contention that land of the petitioner is utilized for the purpose of widening of the national highway and in view of categorical assertion of learned standing counsel for National Highways Authority of India that so far land of the petitioner is not required and the same is not acquired, no further orders are necessary in this writ petition and the same is closed. However, if the land of the petitioner required, National Highways Authority is at liberty to acquire the same by following due process of law.
No costs. Sequel to the same, miscellaneous petitions, if any stand dismissed.
