Heard learned counsel for the parties.
The petitioners claim that there is a civil litigation pending between them and the respondents 4 and 5 vide O.S.No. 77 of 2013 on the file of the District Judge, Krishna at Machilipatnam and the respondents 4 and 5 have also filed a suit which is pending and at the instance of respondent No.4, complaints were filed with respondent No.3 who registered cases in Cr.No. 1 of 2014 under Sections 447, 341, 506 r/w. 34 IPC and Cr.No. 40 of 2014 under Section 468 r/w. 34 IPC against the petitioners. The petitioners further state that they also received summons from the Revenue Divisional Officer, Bandar under Section 107 of Cr.P.C. in MC No. 14 of 2014. In the light of the civil litigations and registration of criminal cases by the respondents 4 and 5, the petitioners allege in this writ petition that the respondent No.3, in particular, was interfering with the civil disputes between the petitioners and the respondents 4 and 5 and therefore, seek a writ of mandamus in that regard.
Learned Government Pleader for Home, on instructions, submits that Cr.No. 51 of 2014 under Section 107 of Cr.P.C. vide MC No. 14 of 2014 and Cr.No. 40 of 2014 under Section 468 r/w. 34 IPC are pending investigation and in regard to Cr.No. 1 of 2014, he submits that investigation was completed and charge sheet was filed before the jurisdictional Magistrate. He says that except registration of cases and investigating the same, the respondents-police never harassed and interfered with the liberty of the petitioners and never tried solve the civil disputes between the petitioners and the respondents 4 and 5.
Recording the aforesaid submissions, no further orders are required to be passed in this writ petition which is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
