1. Heard learned counsel for the applicant and learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicant Guru Charan, seeking anticipatory bail in Case Crime No. 30 of 2020, under Section 376 IPC, Police Station - Nandganj, District Ghazipur, during pendency of trial.
3. In view of the direct facts allegations with respect to rape having been made in the FIR constituting a heinous offence as disclosed, at present, it is difficult to exercise discretion for grant of anticipatory bail in favour of the applicant.
4. Accordingly, the present anticipatory bail application is rejected, leaving it open to the applicant to apply for regular bail, which application when filed may be considered, on its own merit, without being prejudiced by any observation made in this order.
