DAVE Date : 15/02/2012 ORAL ORDER Heard learned advocate for the applicants and it is submitted that even as per version of the complainant about preparation of documents by forging the signature of his father, ultimately the revenue proceedings are pending before the appellate forum and at the same time, prima facie, notice under Section 135(d) of the Code appears on record and even civil suits are also pending. At the stage of complaint opinion of hand writing expert cannot be made sole basis for initiating criminal law into motion.
In the above circumstances, a case is made out for issuance of notice making it returnable on 12.3.2012. Learned APP, waives service of notice on behalf of respondent No.1.
Meanwhile adinterim relief in terms of para 6(B) is granted.
Direct service to respondent No.2 and to be served through Incharge Police officer of the area in which respondent No.2 resides.
