Heard Sri Vijay Prakash Pandey, learned counsel for the applicant and Sri Prashant Kumar, learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to direct the learned Civil Judge (J.D.) Puwayan, Shahjahanpur to decide the Complaint Case No. 781 of 2010, under Section 138 N.I. Act P.S. Khutar, District Shahjahanpur, expeditiously within short span of time.
Learned counsel for the applicant states that the present case under Section 138 N.I. Act is pending since 2010 and till date the same has not been decided, hence, a direction may be issued to the court below to the decide the same expeditiously.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months without permitting undue adjournments to either sides, if there is no legal impediment.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court.
