Heard learned counsel for the petitioners; Shri Sanjay Kumar Singh, learned Standing Counsel for the State respondents.
Petitioners are before this Court with the request to quash the order impugned dated 20.04.2018 passed by Additional Commissioner (Administration) Bareilly Region, Bareilly. Further prayer has been made to command the respondents to maintain status quo over the land in dispute and not to create any third party right by transferring or alienating the land in dispute.
After perusing the record in question and considering the facts and circumstances of the case, once the Court has declined to interfere in the order impugned, then in such a situation, learned counsel for the petitioner has requested that direction may be issued to the Authority concerned to decide the revision under Section 210 of U.P. Revenue Code 2006 at the earliest.
Learned Standing Counsel has not opposed the said prayer.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Additional Commissioner (Administration) Bareilly Region, Bareilly to expedite the hearing of the aforesaid revision and conclude the same expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost but certainly after according opportunity of hearing to all the stake holders in the matter. Meanwhile, it is expected that no third party interest shall be created by the parties in respect of plot in question.
