Heard Sri Vijay Prakash, learned counsel for the petitioner, Sri N.K. Verma, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer that direction should be issued to the respondent authorities not to arrest the petitioner in pursuance of the F.I.R. dated 6.5.2018 registered as case crime no. 852 of 2018 under sections 420, 467, 468, 471, 506, 120-B I.P.C., police station Sihani Gate, District Ghaziabad.
Learned counsel for the petitioner submits that the petitioner is the informant of the case. It appears from the order dated 9.4.2018 passed by A.C.J.M., Court No. 3, Ghaziabad that it has been ordered by him that F.I.R. should also be lodged against the petitioner on account of which police is harassing the petitioner, hence some interim protection be given to the petitioner.
Learned A.G.A. opposed the prayer made in the present petition.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
