Gurbhej Singh vs Settlement Officer Consolidation And Others

High Court Of Judicature at Allahabad|06 January, 2021

JUDGMENT / ORDER

Court No. - 6
Case :- WRIT - B No. - 1788 of 2020 Petitioner :- Gurbhej Singh Respondent :- Settlement Officer Consolidation And 3 Others Counsel for Petitioner :- Nipun Singh Counsel for Respondent :- C.S.C.,Kaushal Kishore Mani
Hon'ble Ajay Bhanot,J.
Heard Sri Rishi Upadhayay, learned counsel holding brief of Sri Nipun Singh, learned counsel for the petitioner.
The only prayer made by learned counsel for the petitioner is to decide the appeal registered as Appeal no. 570 of 2019 (Gurbhej Singh Vs State and others) within a stipulated period of time. This Court does not find any reason to prioritize the hearing of appeal filed in the year 2019 over other cases.
Faced with this, learned counsel for the petitioner recasts his relief and submits that the court may decide the appeal in an expeditious time frame.
Learned Standing Counsel submits that the appellate authority is under an obligation of law to decide the appeal within a reasonable period of time.
In light of the submissions made at the bar, I see no reason why the appellate authority shall not decide the appeal expeditiously in accordance with law. The appellate court shall not grant any unnecessary adjournment to the parties who intend to delay the appeal proceedings.
The writ petition is disposed of.
