ORDER:
This petition is filed to withdraw divorce O.P.No.642 of 2013 from Family Court, Vijayawada and transfer the same to Senior Civil Judge, Nagor Kurnool, Mahabubnagar District.
Wife filed this petition. According to her affidavit, filed in support of the petition, she is residing at Domalapenta village of Mahaboobnagar District and it is difficult for her to attend Vijayawada Court for defending the subject OP, which is at a distance of about 450 kilometers from her native place. She stated that she filed M.C. and D.V.C and both cases are pending before the Judicial Magistrate of First Class, Achampet; that the respondent/husband is attending for two cases and if the subject OP is transferred to Nagor Kurnool which nearest court to Achampet, having jurisdiction, it will be convenient for her and also to the respondent.
The respondent filed counter contending that Nagor Kurnool is 80 kilometers from Domalapenta and wife has to travel 80 kilometers, for the respondent it is 450 kilometers from Vijayawada and at present he has no means and he is depending on his parents, having lost his job because of the cases filed by the wife and it is difficult for him to attend two places i.e., Achampet for the cases filed by wife and Nagor Kurnool for the subject OP, therefore, the application is opposed.
Heard both sides.
Advocates on either side submitted the if the subject OP is transferred to Hyderabad, it will be convenient for both parties because it will be around 250 kilometers for the respondent and 150 kilometers for the wife from their respective places and requested to transfer the subject OP from Vijayawada to Family Court, Hyderabad.
Considering the request of both sides, O.P.No.642/2013 is withdrawn from the Family Court, Vijayawada and transferred to Family Court, Hyderabad for disposal in accordance with law.
The Transfer Miscellaneous Petition is accordingly disposed of. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed in consequence.
