ORDER:
HONOURABLE SRI JUSTICE S.RAVI KUMAR CIVIL REVISION PETITION No.4180 OF 2007 This revision is preferred against order dated 17-4-2007 in E.P.No.304 of 2006 in O.S.No.708 of 2001 on the file of I Additional Junior Civil Judge, Kakinada.
Revision petitioner herein is decree holder and he moved a petition before court below under order 21 Rule 37 and Section 55 of Code of Civil Procedure Code, for arrest of J.Dr. for realization of the decretal amount. Trial court after considering the evidence of D.Hr. and evidence of J.Dr. dismissed execution petition holding that D.Hr. failed to prove that the J.Dr. has got liquidated cash on hand to discharge the decretal debt, aggrieved by the dismissal, present revision is preferred.
Heard both sides.
It is submitted that while dismissing the arrest E.P., liberty was given to the D.Hr. to file separate E.P. for attachment of salary but now subsequent to filing of this revision, the J.Dr. has paid back the entire decretal amount, therefore, no further orders are necessary in this revision.
Recording the said submission, this revision is closed as infructuous. As a sequel to the disposal of this revision, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
