Heard Sri Abhishek Gupta, learned counsel for the petitioner, Sri Jitendra Singh, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioners with a prayer to direct the respondent no.3 for fair and impartial investigation in pursuance of the FIR dated 8.1.2018 registered as Case Crime No.15 of 2018, under Sections 498A, 323, 307, 504, 506 I.P.C., Police Station Dadri, District Gautam Buddh Nagar.
It has been contended by learned for the petitioner that petitioner is the informant of the present case and he has come up before this Court with a prayer that direction be given to respondent no.3 to ensure the fair investigation in the matter as he apprehends that investigation is not being carried out in a fair and proper manner. He further submits that the marriage between the petitioner and co-accused Jainendra was solemnized on 18.6.2017, but after marriage some dispute arose between the parties, hence, petitioner lodged the FIR being Case Crime No.15 of 2018, under Sections 498A, 323, 307, 504, 506 I.P.C. and 3/4 D.P. Act against her husband and his other family members and the same has been challenged by them before this Court in Crl. Misc. Writ Petition No.2213 of 2018 in which interim order has been passed with respect to family members of husband of the petitioner and petition with respect to husband has been dismissed on 31.1.2018, the said fact has been mentioned in paragraph no.10 of the writ petition.
Considering the facts and circumstances of the case and submissions advanced by learned counsel for the parties, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of three months from the date of production of a certified copy of this order.
It is further directed that the S.S.P., concerned shall supervise the investigation and ensure that the same is completed speedly without any undue delay.
With the above directions this petition is finally disposed of.
