NAGARAJU NAGURU COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to enlarge the bail to the petitioner/accused No. 1 in the event of his arrest by the SHO, Alwal Police Station, Cyberabad in connection with the Crime No.167 of 2014 or Voluntary surrender before the VI Metropolitan Magistrate Court, at Medchal, Cyberabad in Crime No. 167 of 2014 of Alwal Police Station, Cyberabad, pending investigation and trial on such terms and conditions.
The Court made the following Order:
“This Criminal Petition is filed under Section 438 Cr.P.C. seeking anticipatory bail to the petitioner–A1 in connection with Cr.No.167 of 2014 of Alwal Police Station, Cyberabad, registered for the offences punishable under Section 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act.
Heard the learned counsel for the petitioner and the learned Public Prosecutor for the Respondent-State.
The marriage between the petitioner and the de facto complainant took place on 23.05.2013 and thereafter, on account of disharmony in the family, petitioner appears to have got issued a legal notice dated 13.02.2014, requesting the de facto complainant to join with him. The present complaint is lodged on 17.02.2014. The allegations in the complaint are general in nature.
Considering these facts, I am inclined to grant anticipatory bail to the petitioner.
Accordingly, the Criminal Petition is allowed and the petitioner/A1 shall be enlarged on bail in the event of his arrest on condition of his executing a personal bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, Alwal Police Station, Cyberabad.”
