Heard learned counsel for the parties.
The petitioners allege that under road widening scheme, their house properties are likely to be affected and demolished and consequently they may be dispossessed without any notice and without following due process of law. The present writ petition is, therefore, filed seeking a writ of mandamus against the respondents not to interfere with the possession and enjoyment of the petitioners over their respective houses without following due process of law under the Land Acquisition Act or any other law.
Learned standing counsel for the Municipal Corporation, on instructions, submits that the road widening scheme is, no doubt, under consideration and at present only survey operations are being undertaken to know the exact road widening and also about the possibility of house property being affected and as on today there is no move on the part of the Municipal Corporation so as to affect the petitioners’ houses. He also submits that as and when any decision is taken by the Municipal Corporation for taking the petitioners’ house property, they would follow the requisite provisions of law and necessary action would be initiated in accordance with law.
Even otherwise, if the petitioners’ property is required for the purpose of road widening, the Municipal Corporation shall have to follow the provisions of Sections 147 and 148 of the Greater Hyderabad Municipal Corporation Act, 1955 or provisions of the Land Acquisition Act or any other provisions of law, as applicable.
In view of the statement of the learned standing counsel for Municipal Corporation appearing for the respondents, as above, no further orders are necessary to be passed in this writ petition which is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No costs.
