Respondent This Criminal Petition is filed u/s.438 Cr.P.C praying to enlarge the petitioner on bail in the event of his arrest in Cr.No.41/2017 of Srirangapatna town P.S., Mandya district for the offence P/U/S 323, 353, 504 r/w 34 of IPC.
This Criminal Petition coming on for orders this day, the court passed the following:
O R D E R Heard the learned counsel for the petitioners and the learned High Court Government Pleader for the respondent.
2. The respondent-Police charge sheeted the petitioners for the offence punishable under Sections 504, 323, 353 r/w 34 of IPC in their Crime No.41/2017.
3. On the complaint lodged by the Deputy Tahsildar, Nada Kacheri, Kirangur Village, Srirangapattana Taluk, alleging that the petitioners being the land owners of the building where Nada Kacheri is located, barged into the office, picked up quarrel with him in respect of excess electrical billing, abused the officials filthily and manhandled them, etc; the incidence occurred in the presence of Tahsildar.
4. Having regard to the nature of the allegations there is no impediment to allow the petition. Accordingly, I pass the following order:
Petition is allowed. Petitioners are granted anticipatory bail for a period of three weeks in Cr.No.41/2017 registered by the respondent-police. Within the above period they shall surrender before the jurisdictional Court and move for regular bail. Till disposal of their regular bail petition, this order shall be in force.
They shall co-operate with the Investigating Officer during the further course of investigation and shall not enter into quarrel with the complainant or his colleagues.
