THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.29096 of 2012 ORDER :
The writ petition is filed seeking for direction to consider the petitioners applications and inspect the proposed site and allow the petitioners to participate in the interview and other selection process for appointment of dealership at Dharmojiguda, Nalgonda District.
2. On 21.10.2011 a notification was issued by the respondent-Corporation in Eenadu Newspaper, calling for applications for enlistment as petroleum out let dealer. The petitioners’ partnership firm, applied for the retail out let (petrol pump) at Dharmojiguda Village, Nalgonda District. The application of the petitioners was not considered on the ground that name of one of the partners Sri Gajji Naveen Kumar was not tallying with the name recorded in SSC certificate, where it was mentioned as Naveen Yadav Gajji. Aggrieved thereby, this writ petition is instituted.
3. By an order dated 21.09.2012, this Court passed the following order :
“In response to the notification dated 21.10.2011 issued by the respondent Corporation inviting applications for setting up retail outlet (petrol pump) at Dharmojiguda Village, Nalgonda District, the petitioners three in number, have submitted their applications to the respondent for grant of retail outlet dealership of petroleum products under a partnership firm. It is stated that the application of the petitioners is not being considered on the ground that the name of one of the partners by name Naveen Kumar is not tallying with the name in the SSC certificate. It is stated that in the application, the name of one of the partners is written as Gajji Naveen Kumar, whereas in the SSC certificate, it is mentioned as Naveen Yadav Gajji.
On instructions, it is submitted by the learned Standing Counsel appearing for the respondent that, the application of the petitioners is not being considered only on the ground that the name of one of the partners by name Naveen Kumar is not tallying with the name in the SSC certificate. Learned Standing Counsel further submitted that in the application filed by the petitioners, the names of other two partners are correctly mentioned. It is further submitted that with regard to the partner by name Naveen Kumar, his date of birth mentioned in the application and in the SSC certificate is same.
In that view of the matter, there is no dispute with regard to the identity of the person by name Naveen Kumar. Hence, there shall be interim direction to the respondent to consider the applications of the petitioners along with the applications of other applicants and take necessary steps.”
4. The respondent-Corporation, filed counter affidavit wherein it is stated that as per interim orders passed by this Court, the Corporation has called the petitioners for interview and the petitioners were short listed and stood as first empanelled candidate.
5. Learned counsel for the petitioners submit that though the petitioners are considered in pursuant to the interim orders and empanelled, on the ground that the writ petition is pending, no further steps are taken.
6 . An elaborate interim order was passed on 21.09.2012. The view expressed by this Court on identity of Sri Gajji Naveen Kumar is not controverted by respondent. As admitted by the Respondent-Corporation, in Para No.6 of the counter affidavit, in compliance to the interim orders, identity of the petitioners was ascertained and the petitioners were subjected to selection process and are now enlisted. Since the relief sought by the petitioners is granted by the respondent in pursuant to the interim orders, no further orders are required in this writ petition.

Hence, the Writ Petition is disposed as no further orders are required, leaving it open to the respondent-Corporation to finalize the selection process to enlist petroleum outlet dealer at Dharmojiguda Village, Nalgonda District in pursuant to notification dated 21.10.2011. There shall be no order as to costs.
8. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
