(PER : HONOURABLE MR.JUSTICE R.P.DHOLARIA) The present application has been preferred by the convict through jail seeking temporary bail on the ground of agriculture operations.
We have perused the application and documents on record. It emerges from the record that against the sentence of life imprisonment, the convict served out the sentence of more than 2 years and 1 month including the period of set-off. During this period, he has enjoyed once temporary bail on the same ground, in the months of December 2012 January 2013. Previously, he had preferred an application being Criminal Misc. Application No.10762 of 2013 on the same ground, which was dismissed by this Court vide order dated 08.07.2013 and he had also preferred another application being Criminal Misc. Application No.12802 of 2013 on the ground of construction of the house, which was also dismissed by this Court vide order dated 12.08.2013. Therefore, no case is made out at this stage for fresh release. The reason stated in the application also does not inspire confidence to use judicial discretion in favour of the convict to release him on temporary bail. The application is dismissed. This order be communicated to the applicant in jail by the Registry.
