Heard learned counsel for the applicant as well as learned A.G.A. for the State.
Learned counsel for the applicant has contended that the applicant has been shown to be involved in four cases in the gang-chart in which he is on bail. Copy of the bail orders have been annexed as Annexure Nos.3, 4, 5 and 6 to the affidavit filed in support of the bail application. The applicant is languishing in jail since 13.12.2018.
The learned A.G.A. has vehemently opposed the prayer.
Considering the rival submissions and the nature of accusation and the severity of punishment in case of conviction and the nature of supporting evidence, reasonable apprehension of tampering with the witness and prima facie case, without expression any opinion of merit of the case, this bail application is allowed.
Let the applicant - Gulzar Alias Ashu involved in Case Crime No. 813 of 2018, under Sections 3 (i) of U.P. Gangster Act, Police Station - G.R.P., District - Kanpur Nagar be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
