Heard Sri Devendra Gupta, learned counsel for the applicant, Sri I.P.S. Rajpoot, learned A.G.A. appearing for the State and perused the record.
This Application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to direct the court below to decide the trial in Case Crime No. 0615 of 2017 (State Vs. Ramesh Chand @ Boby and anr.), under Sections 452, 324, 504 & 506 of IPC, P.S. Sihani Gate, District Ghaziabad, expeditiously within reasonable time pending before Additional Chief Judicial Magistrate III Ghaziabad.
Learned counsel for the applicant states that the charge-sheet in this case was filed in the year 2017 and till date the trial court has not framed the charge and hence, a direction may be issued to the court below to decide the same expeditiously. He has also annexed the order sheet of this case beginning from 20.03.2018 onwards.
Perusal of the order sheet which has been annexed, indicates that till the date, the charge has not been framed.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months without permitting undue adjournments to either side, if there is no legal hurdle.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 to 3 as it is an innocuous order. If the O.P. No.2 to 3 feels aggrieved, they may approach this Court.
