Heard counsel for the petitioners.
The writ petition has been filed seeking the following relief :
(i) issue a writ, order or direction in the nature of ad-interim mandamus commanding/directing the respondents to record the names of petitioners in the revenue record as mentioned in the order dated 07.04.1986 passed by Consolidation Officer in Suit No.510 (Hardev Vs. Sarkar).
In my considered opinion, in case an order passed by Consolidation authorities is required to be implemented in the revenue records as appears to be the case of the petitioners, the remedy available to them is by means of an application under Rule 109-A of the U.P. Consolidation Holdings Rules.
Although, it is sought to be contended that such an application was in fact filed by the father of the petitioners, there is no material on record to indicate that it was actually filed.
From the averments made in the writ petition, it appears that only reminders and representations have been made to the concerned authorities.
Under the circumstances, the writ petition is disposed of directing the petitioners to file an appropriate application under Rule 109-A of the U.P. Consolidation Holdings Rules for the relief being sought by him.
In case such an application is filed by the petitioners within a period of three weeks from today, it is expected that the authority concerned shall decide the same expeditiously.
Subject to above, this writ petition stands disposed of.
