This writ petition is filed for a mandamus declaring action of the 1st respondent in issuing proceedings in Proc.Rc.No.J/496/2014, dated 15-07-2014 and its consequential modification Proc.Rc.DT.KRC/ 496/2014, dated 21-07-2014 issued by the 1st respondent as arbitrary and illegal and for a consequential direction to set the proceedings.
2. The case of the petitioner is that she is appointed as fair price shop dealer vide authorisation No.287/MDPC-GDV/2008, dated 17-05-2008 at D.No.1-56, Alluru and has been running the same by distributing essential commodities to the card holders without any complaint. It is stated that the 1st respondent kept her authorisation under suspension temporarily vide proceedings in Proc.Rc.No.J/496/2014, dated 15-07-2014 on the ground of certain irregularities being committed by the petitioner in distribution of essential commodities. It is also stated that the 1st respondent vide proceedings dated 21-07-2014 modified the earlier proceedings dated 15-07-2014 giving in-charge of the petitioner’s fair price shop to another fair price shop dealer. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.
4. Since it is stated that a statutory appeal is filed by the petitioner against the impugned proceedings before the 3rd respondent-Joint Collector, the petitioner can raise all her contentions before the Appellate Authority, which shall be considered by the Joint Collector as per law.
5. Therefore, the 3rd respondent is directed to dispose of the appeal filed by the petitioner as expeditiously as possible preferably within a period of eight (8) weeks from the date of receipt of a copy of the order. Till such orders are passed on the appeal, the impugned proceedings dated 15-07-2014 as well as the proceedings dated 21-07-2014 shall remain suspended.
With the above direction, the writ petition is disposed of.
No costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
