Heard Sri Lok Nath Shukla, learned counsel for the petitioner, Sri Ishant Shishu, learned counsel for Union of India and Sri Vikas Budhwar, learned counsel appearing for respondents no. 2 and 3.
The petitioner has submitted his online application form for allotment of retail outlet dealership of Bharat Petroleum Corporation Ltd.
The petitioner by means of this petition want that a direction be issued to the respondents to allow him to correct gata number filled up by him in the online application form.
A Division Bench of this Court had dismissed a similar petition being Writ A No. 7079 of 2019 (Kaushlesh Upadhyay Vs. Union of India and 2 others) vide order dated 1.3.2019, holding that in exercise of discretionary jurisdiction under Article 226 of the Constitution, this Court is not expected to pass whimsical orders not founded on any logic but dependent on individual discretion and wisdom. When instructions issued by authority inviting applications are very clear, there is no reason to create disturbance in the scheme of such instructions, by passing orders on judicial side on the basis of consideration of facts in individual cases. As such the prayer for making correction in the online application form was turned down.
We do not find any good reason to deviate from the above reasoning and as such do not deem it fit to exercise discretionary jurisdiction.
The writ petition is disposed of with the liberty to the petitioners to press his representation, if any.
