JUDGMENT / ORDER

ADMIT.
Shri Harshad K. Patel, learned advocate waives service of notice of admission on behalf of the respondents. The following substantial questions of law arise for determination in the present Second Appeal;
(i) Whether in the facts and circumstances of the case both the Courts below were justified in disbelieving the oral gift by Mariam in favour of the original defendant for which necessary entry was made in the city survey record in the year 1991?
(ii) Whether both the Courts below have materially erred in ignoring the sale deed of Mariam by which she purchased the property from Rajpipla Nagarpalika and consequently holding that Mariam had no authority to gift the property in question?
(iiii) Whether in the facts and circumstances of the case, the learned trial Court was justified in passing the decree and/or operative portion of the order in the suit, which was considered by the learned appellate Court.
