JUDGMENT / ORDER

1.0 The matter was mentioned in the morning for urgent circulation today. The permission was granted. The papers are received from the Registry.
2.0 Present application is filed by the convict through his sister - Rasidaben Mahmadsha seeking Parole for a period of 30 days as the mother of the convict had died on 11th May 2012 (in the night between 10th and 11th).
3.0 Rule.
Learned Additional Public Prosecutor Mr. Patel waives service of process of Rule.
4.0 Learned Additional Public Prosecutor made available for perusal the Jail Remarks. The convict is undergoing life imprisonment for offences punishable under Sections 302 and 323 of the IPC in Sessions Case No. 6 of 2005. The convict has, by now, undergone imprisonment of 06 years, 08 months and 40 days. He has enjoyed Temporary Bail on two occasions, furlough on three occasions and parole on 11 occasions and every time, he reported in jail in time. Nothing adverse is found against the convict in the Jail Remarks.
5.0 Taking into consideration the contents of the application, the application is allowed. The applicant - convict is ordered to be released on Parole for a period of 30 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authorities.
5.1 The convict shall surrender to the jail authorities on expiry of the Parole period.
5.2 Rule is made absolute to the aforesaid extent.
