Gulam Mustafa @ Naatay S/O ... vs State Of U.P. Thru Secy. Home & Ors.

High Court Of Judicature at Allahabad|01 February, 2010

JUDGMENT / ORDER

Hon'ble Yogendra Kumar Sangal,J.
Heard learned counsel for the petitioner and learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 863 of 2009, under Sections 323/147, 504 & 506 IPC read with Section 3 (1) (X) SC/ST (Prevention of Atrocities) Act, police station Kotwali Akbarpur, district Ambedkar Nagar.
We have gone through the contents of the FIR as well as injury report of injured persons.
We do not find any merit so as to quash the impugned FIR.
Since the FIR discloses commission of cognizable offence, the same cannot be quashed.
The writ petition is misconceived and is accordingly dismissed.
However, it is provided that if petitioner surrenders and moves application for bail, the same shall be considered and disposed of expeditiously by the courts below.
