Pursuant to the order passed by this Court an amendment application dated 08.02.2021 was filed by the counsel, the same is taken on record.
From perusal of the same, it appears that certain amendments were sought in the prayer clause of the petition.
The amendment application is allowed.
Learned counsel for the petitioner is permitted to make necessary amendment in the petition at appropriate places during course of the day.
Heard Sri Mahboob Ahmad, learned counsel for the petitioner and perused the record.
The petitioner is before this Court for a direction to Civil Judge (J.D.) Baasi, Siddharth Nagar, to decide the Original Suit No.474 of 1992 (Ghulam Abdul Qadir Alvi Vs. Mohd. Mukhtar Ahmad since deceased and others) within stipulated period.
In view of the order proposed to be passed, notices need not go to the private respondents.
It is argued by learned counsel for the petitioner that since the matter is pending consideration before the court below for a long time he is suffering irreparable loss.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid suit in accordance with law expeditiously within a period of one year but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
